ti-emu: Cease and Desist or Violation of owner's rights?

i'm sorry for the inconvenience that this may have caused.

alas, i am unable to delete the files from my tripod account, for i don't have the password anymore. if you contact tripod, please tell them that i give my consent for you to delete the page.

don't think i'm not giving up without a fight.

I HELP your business, not take away from it. There was someone who downloaded a ti92 rom, and then liked it so much, he bought a ti92, yet i don't see any commission in my pocket.

i have owned EACH AND EVERY ONE OF THOSE CALCS at ONE TIME OR ANOTHER. maybe i got the ti8x for 30$, and then sold it for 30$. i still owned it.

programmers dread when they get email from someone with some odd version of a rom, saying "your program xxxxx doesn't work!!" what is that programmer supposed to do? hunt down that version and buy it just to appease the few people that have that version? even if they download that rom, and then delete it, they are helping ti graphing calculator's fame.

also, when programming, it's much easier to use an emulator to test out the program, than use the graphlink OVER AND OVER, destroying the link port and the link.

plus, some people DON'T want to pay the 35$ for your graphlink. some people want to make their own. there is no rom dump software for the homemade serial cable. for those people, this site is a blessing.

i have a disclaimer on the site stating that it is illegal to download it if you don't own it. other people's actions are not my responsibility.

copyright laws state that the object in question must still be in production. can you tell me that you still produce ti85 rom 2.0? i think not. if i remove the latest versions of the roms, (ie ti82 rom 19.0 and ti85 10.0) my page is perfectly legit. i suppose you haven't found the site that offers a dissassembled ti86 rom 1.2, have you?

While we appreciate the interest you have shown in TI calculator products, it
has come to our attention that you have been associated with the distribution
of files which contain a copy of the copyrighted ROM contents of TI graphing
calculators. TI strongly objects to this illegal distribution of the
copyrighted ROM contents of Texas Instruments products.

The purchaser of a TI graphing calculator acquires the ROM contents for his or
her own use in the product they purchased. The license granted to them does
NOT give them a right to copy and distribute the copyrighted ROM contents.
Making a copy and distributing that copy to any other person is a copyright
infringement. We must request that you take the following steps immediately:

1) Remove any copies of software containing ROM contents that have been placed
on FTP servers, web servers, or other distribution vehicles.

2) Notify users of any interest groups where the illegal copy was announced
that the illegal copy was published without permission from the copyright
holder and has been removed from the distribution sites.

While some may argue that a graphing calculator owner may make a copy of the
ROM contents from the calculator he or she owns for his or her personal use,
copyright law does not grant anyone a right to copy and distribute the ROM
contents without express permission from the copyright holder. Given that
under the copyright law owners may be allowed to make a copy of the ROM
content
of the machine they own does provide an option for distributing an emulator to
such owners. Again, we do appreciate the enthusiasm for and support of Texas
Instruments products.

Please feel free to contact me if you have any questions.

Best regards,
Paul King
