He didn't ask the teacherl to take the test, so the teacher was only indirectly
segregating (if that).  I am sure if this student asked to take the test, the
teacher would have let him.  There is nothing that says the teacher has to ask
everyone in the school if they want to take the test.  So I doubt you could sue
the school or the teacher.
