They would have absolutely no right to tell you to remove it. Unless you
speficically sold it they have no way to prove it's not just a backup and
therefor they can stuff it.

Just as an example, if you had a copy of Photoshop on your website and Adobe
knew about it but didn't send you a letter, would they let you keep that on
your
server, assuming disk space wasn't a problem? :)
