I think you should make the game but don't name it StarFox.  Name it
something completely different like FarStox or something.  Mr. Reno
seems to be concerned with the StarFox name and not the game. 
Besides, you could name the main character something unique like
'Shroud'.

Seriously though, I'd suggest making it, though I would change a few
things to get NOA off your back.
